The two things that matter most: everything Komiti produces is a draft that a person has to check before it's used or relied on, and Komiti is not a registered tax agent, accountant or lawyer — it gives general information, not advice about your situation.

1. What Komiti does

Komiti helps Australian businesses organise compliance work. It generates setup checklists, answers general questions about published rules, and drafts documents (including meeting minutes) from information or recordings you provide. It does this using AI, grounded in publicly available guidance from sources such as the ATO, ASIC, Fair Work and state regulators.

2. What Komiti is not

Not a registered tax agent or BAS agent. Komiti does not prepare or lodge returns or activity statements on your behalf, does not advise on your specific tax liabilities or entitlements, and does not represent you to the ATO. Those are tax agent services under the Tax Agent Services Act 2009 and require registration with the Tax Practitioners Board.
Not a law firm. Komiti does not give legal advice, recommend a business structure for your circumstances, or draft or review contracts.
Not a financial adviser. Komiti does not provide financial product advice.

Where something falls outside what Komiti can properly do, it will tell you so and suggest you speak to a registered tax agent, accountant, bookkeeper or solicitor. Please take that seriously — it isn't a disclaimer for its own sake.

3. Everything is a draft until you check it

AI output contains errors. Assume it will, at least small ones. Every document Komiti produces is marked as an AI-assisted draft requiring verification, and nothing is final until you have read it, corrected anything that's wrong, and approved it. That review step is a condition of using the service, not an optional extra. You are the person who decides whether a document is accurate and fit to be used or lodged.

4. Recording meetings is your responsibility

If you use Komiti to record or upload a meeting, you must obtain the consent of everyone being recorded before recording starts. Komiti requires you to confirm this and logs your confirmation, but the legal obligation is yours.

Recording laws in Australia are state-based and genuinely complicated — in NSW the Surveillance Devices Act 2007 restricts recording private conversations, with exceptions that depend on the circumstances, and penalties are set in penalty units rather than a fixed dollar amount. We require documented consent as a matter of service policy because it is the safe and courteous approach, not because we can tell you what the law requires in your particular situation. If you're unsure, get advice before you record.

5. What you agree not to do

Upload recordings of people who haven't consented to being recorded.
Upload material you don't have the right to share, or that is unlawful.
Present Komiti's output as professional advice, or as a document verified by a registered practitioner.
Rely on Komiti's output without reading it.

6. Early access, pricing and turnaround

Komiti is in early access. Some features are free while we build them out; where a price is shown, that is what applies. Planned future pricing is labelled as planned and is not a commitment. Turnaround times for document jobs are agreed with you per job — we would rather set a realistic expectation than publish a service level we haven't yet proven at volume. If we're going to miss an agreed timeframe, we'll tell you before the deadline, not after.

7. If something goes wrong

Tell us at [email protected]. If a document we produced has a material problem, we'll redo it. If we can't put it right, we'll refund what you paid for that job. Nothing in these terms excludes rights you have under the Australian Consumer Law, including guarantees that services be provided with due care and skill. To the extent the law allows, our liability for any claim connected with the service is limited to re-supplying the service or refunding the amount you paid for it.

8. Your information

How we handle information is set out in our Privacy Policy, including which third-party providers process it and how long we keep it.

9. Changes and ending the service

We may update these terms; the date at the top will change. You can stop using Komiti at any time and ask us to delete your information. We may suspend access if these terms are being breached.

10. Governing law

These terms are governed by the laws of New South Wales, Australia.

These terms are written to be accurate and readable. They have not yet been reviewed by a lawyer. If you need reviewed terms for a procurement or due-diligence process, tell us and we'll arrange that before you sign anything.
